01Who we are, and what these terms cover

This website and the OLEVATE brand are owned and operated by Ascension Health Circle Pty Ltd ("OLEVATE", "we", "us", "our"). These terms govern your use of olevate.com and every purchase you make from us, including subscriptions. By using the site or placing an order, you agree to them.

If anything here is unclear, write to us at support@olevate.com before you order. We would rather explain than surprise you.

02Eligibility

You must be at least 18 years of age to purchase from this site. OLEVATE Complete is a formulated supplementary sports food and is not suitable for children under 15 years of age or pregnant women; by ordering, you confirm the product is not being purchased for use by either.

03Our products and product information

OLEVATE Complete is a food, not a medicine, and nothing on this site is medical advice. Information about ingredients, doses and serving suggestions is provided for transparency and general guidance only. Always read the label and follow the directions for use. If you have a medical condition, take medication, or have any concerns, consult your doctor, pharmacist or dietitian before use.

We may refine the formulation, flavouring or packaging over time. The label on the pouch you receive is the authoritative statement of its contents for that batch.

04Orders

Your order is an offer to purchase. A contract is formed when we send you an order confirmation. We may decline or cancel an order where a product is unavailable, where we reasonably suspect fraud or resale at scale, or where a pricing or listing error has occurred; if payment has been taken, it will be refunded in full.

05Pricing and payment

All prices are in Australian dollars and include GST where applicable. Payment is processed securely at checkout through our payment providers; we do not see or store your full card details. We may change prices at any time, but changes never affect an order already confirmed.

06Subscriptions

Subscriptions are available as a 30-day supply (one pouch, 15% off, billed every 4 weeks) or a 90-day supply (three pouches, 25% off, billed every 12 weeks). By subscribing you authorise us to charge your nominated payment method on the selected recurring schedule until you cancel.

You can pause, skip a delivery, swap flavours or cancel at any time through your account portal, with no phone calls and no retention scripts. Changes, including cancellation, take effect immediately provided they are made before your next billing date; charges already processed relate to a delivery already in motion and will be fulfilled.

If a subscription price is ever to change, we will notify you by email at least 14 days before the new price applies, so you can adjust or cancel first.

07Shipping and delivery

We ship within Australia. Delivery timeframes shown at checkout are estimates and can be affected by carriers and circumstances beyond our control. Risk in the products passes to you on delivery to your nominated address; please ensure the address is complete and accurate.

08The Empty Pouch Guarantee

Use OLEVATE Complete daily for up to 60 days from delivery. If you do not feel it has earned its place, we will refund the full purchase price of that pouch, even if the pouch is empty.

To keep the guarantee generous and sustainable, it works like this: it applies to your first pouch of each flavour, one claim per customer and household per flavour; contact support@olevate.com with your order number within 60 days of delivery; we may ask you to return the pouch, in which case we cover reasonable return postage, or simply to confirm its disposal. Approved refunds are processed to your original payment method, normally within 10 business days.

This guarantee is our promise on top of your legal rights. It does not limit or replace them.

09Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

If a product arrives damaged, faulty or not as described, contact support@olevate.com and we will make it right at no cost to you.

10Health and allergen notice

Formulated supplementary sports food. Not suitable for children under 15 years of age or pregnant women. Should only be used under medical or dietetic supervision where relevant, and in conjunction with a balanced diet and appropriate exercise program. Discontinue use and consult your doctor if you experience any adverse reaction.

OLEVATE Complete contains milk. It is manufactured in a facility that also processes other allergens; refer to the allergen statement on the pouch for the authoritative declaration for your batch.

11Intellectual property

OLEVATE, the OLEVATE mark and logo, and all content on this site, including copy, design, imagery and the formulation presentation, are owned by Ascension Health Circle Pty Ltd. You may not reproduce or use them for commercial purposes without our written permission.

12Reviews and submissions

If you submit a review or other content, you confirm it reflects your honest, genuine experience, and you grant us a non-exclusive, royalty-free licence to display it in connection with OLEVATE. We do not publish reviews we know to be fabricated, and we disclose any incentive provided in exchange for a review.

13Acceptable use of the site

You agree not to misuse the site, interfere with its operation, attempt unauthorised access, scrape it at scale, or use it for any unlawful purpose. We may suspend access where we reasonably believe this clause has been breached.

14Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.

15Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. To the extent permitted by law, our liability for any claim arising out of or in connection with these terms or your order is limited, at our election, to resupplying the relevant products or refunding the amount you paid for them, and we are not liable for indirect or consequential loss.

16Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. Material changes to subscription terms will be notified to active subscribers by email.

17Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
